Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the NIVIN EMR platform and related SMS messaging services provided by NIVIN IT Clinical Solutions, SRL ("NIVIN", "we", "us", or "our"). By using our services, you agree to these Terms.

1. Service Description

NIVIN EMR is a cloud-based Electronic Medical Records platform designed for healthcare providers. The platform includes clinical documentation, prescription management, appointment scheduling, and patient communication via SMS.

2. SMS Messaging Terms

As part of the NIVIN EMR service, you may receive SMS messages to the phone number registered in the system. By providing your phone number to your healthcare provider for use in NIVIN EMR, you consent to receive the following types of messages:

• Account Verification: One-time codes (OTP) for secure login.
• Prescription Notifications: Codes and instructions for prescription pickup at pharmacies.
• Appointment Reminders: Notifications about upcoming appointments.
• System Notifications: Important updates related to your healthcare account.

Message Frequency

Message frequency varies based on clinical activity. You may receive approximately 1-10 messages per month.

Costs

Message and data rates may apply. NIVIN does not charge for SMS messages, but your mobile carrier may charge standard messaging rates. Contact your carrier for details.

Opt-Out

You may opt out of SMS messages at any time by replying STOP to any message from NIVIN EMR. You will receive a confirmation message and will not receive further SMS messages. Please note that opting out may affect your ability to access the platform, as login requires SMS verification.

3. User Accounts

User accounts are created by authorized healthcare providers. You are responsible for maintaining the security of your account and must not share your verification codes with anyone. NIVIN will never ask you for your verification code outside of the login process.

4. Acceptable Use

You agree to use the NIVIN EMR platform only for its intended purpose of healthcare management. You must not:

• Attempt to access records or data belonging to other users without authorization.
• Use the platform for any unlawful purpose.
• Attempt to interfere with the security or operation of the platform.
• Share login credentials or verification codes with unauthorized persons.

5. Healthcare Provider Responsibilities

Healthcare providers using NIVIN EMR are responsible for:

• Obtaining patient consent for the collection and use of health information.
• Obtaining verbal consent from patients for SMS communications during patient registration.
• Ensuring the accuracy of patient information entered into the system.
• Complying with applicable healthcare regulations and data protection laws.

6. Data Privacy

Your use of the NIVIN EMR platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. We do not sell or share your mobile information with third parties for marketing purposes.

7. Intellectual Property

The NIVIN EMR platform, including its design, code, and content, is the property of NIVIN IT Clinical Solutions, SRL. You may not copy, modify, or distribute any part of the platform without written permission.

8. Limitation of Liability

NIVIN EMR is a record-keeping and communication tool. It is not a substitute for professional medical judgment. NIVIN is not liable for clinical decisions made by healthcare providers using the platform. We provide the service "as is" and make no warranties regarding uninterrupted or error-free operation.

9. Service Availability

We strive to maintain high availability of the NIVIN EMR platform. However, we may occasionally need to perform maintenance or updates. We will provide advance notice when possible for planned downtime.

10. Modifications to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via the platform or email.

11. Governing Law

These Terms are governed by the laws of the Dominican Republic. Any disputes arising from these Terms shall be resolved in the courts of the Dominican Republic.
